INTRODUCTION AND ACCEPTING THE TERMS

Welcome to RacketAlpha! These Terms of Service ("Terms"), which include and hereby incorporate the Privacy Policy at https://racketalpha.com/privacy ("Privacy Policy"), are a legal agreement between Lowcode Garage LLC ("Lowcode Garage," "the Company," "us," "our," or "we") and you ("you" or "your").

RacketAlpha ("RacketAlpha," "Site," or "Service") is a web app developed and operated by Lowcode Garage LLC. It provides insights on racket sports influencers (their public content, stories, and engagement metrics) and in the future will enable brands to discover and collaborate with them.

By using or accessing RacketAlpha through https://racketalpha.com or any related web-based features or integrations (collectively, the "Service"), you agree that:

1. You are 16 years of age or older,
2. If you are the age of majority in your jurisdiction or older, you have read, understood, and accept to be bound by these Terms, and
3. If you are between 16 and the age of majority, your legal guardian has reviewed and agreed to these Terms.

We do not knowingly collect or solicit personal information from children under 16. If you are under 16, you may not register for or use the Service. If we learn that we have collected personal information from someone under 16, we will delete that information.

We are constantly improving RacketAlpha, so these Terms may change along with the Service. If we make material changes, we will notify you (for example, by posting a notice on the Site or sending an email). If you do not agree to the new Terms, you must stop using RacketAlpha. Continued use after changes are effective means you accept the updated Terms.

RIGHTS TO USE THE SERVICE

RacketAlpha provides access to influencer insights, stories, analytics, and (in the future) brand collaboration and premium account features.

Subject to your compliance with these Terms, Lowcode Garage grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use and access the web app for your personal or internal business use, unless otherwise agreed in writing.

You agree not to (and not to attempt to):

• Use RacketAlpha outside what is permitted by these Terms.
• Copy, adapt, modify, distribute, license, sell, publicly perform, reverse engineer, or otherwise exploit the Service or its code.
• Use scraping, bots, or automated data-mining tools except as permitted under our API terms (if applicable).

We may suspend or discontinue the Service (or parts of it) at any time without notice.

YOUR ACCOUNT

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must keep your information accurate and up to date.

If you believe your account has been compromised, notify us immediately at team@racketalpha.com.

We may suspend or terminate your account for violations of these Terms without prior notice.

COMMUNICATIONS

By using RacketAlpha, you agree to receive communications from us (email, notifications, or web-based messages). These communications satisfy any legal requirement that such communications be "in writing."

You may use RacketAlpha to connect or communicate with other users or brands (when available), but you may not send spam, unsolicited marketing, or abusive messages.

PAYMENT

RacketAlpha offers both free and paid services. Paid features may include advanced analytics, engagement tracking, influencer listings, brand-access dashboards, or collaboration tools.

All payments are handled through trusted third-party payment providers. By purchasing or subscribing to any paid feature, you agree that:

1. Subscription Renewals: Subscriptions or paid plans may automatically renew unless canceled prior to the renewal date following the instructions in your account settings.
2. Billing & Fees: You authorize Lowcode Garage (through its payment processor) to charge your provided payment method for all applicable fees.
3. Refunds: All payments are non-refundable except as required by law or where expressly stated in the Service.
4. Price Changes: We may adjust pricing or introduce new plans. We will provide reasonable notice before any material change takes effect.
5. Taxes: You are responsible for any taxes associated with your use of paid services, excluding our income taxes.
6. Third-Party Payment Processors: Payment providers are solely responsible for transaction security, card storage, and payment compliance.

Failure to pay fees when due may result in suspension or termination of your access to paid features.

CANCELLATION

All purchases are non-refundable. You can cancel your subscription at any time by contacting us using the contact information provided below. Your cancellation will take effect at the end of the current paid term.

INTELLECTUAL PROPERTY RIGHTS

All rights, title, and interest in RacketAlpha (excluding Your Content and publicly available influencer data) are owned by Lowcode Garage or its licensors. You may not reproduce, distribute, or exploit RacketAlpha's content, analytics, or design elements without our written consent.

YOUR CONTENT

Any content you upload (profile information, comments, collaboration listings, etc.) remains yours.

By submitting content, you grant Lowcode Garage a worldwide, royalty-free, sublicensable license to host, use, reproduce, and display your content as necessary to operate, improve, or promote the Service.

If you delete your content, we will remove it from active use, but copies may remain in backups or archives as required by law or security policy.

We may remove or restrict content that violates these Terms or applicable laws.

RULES OF CONDUCT

When using RacketAlpha, you agree not to:

• Harass, threaten, or abuse others.
• Post illegal, offensive, or infringing content.
• Attempt to hack, disrupt, or overload the Service.
• Collect data beyond authorized use.
• Engage in fraudulent, misleading, or unethical activity.
• Violate any applicable laws or platform API terms.

We reserve the right to determine violations and take action, including account suspension, content removal, or referral to authorities.

We may—but are not obligated to—monitor user activity and content.

AI & AUTOMATED INSIGHTS

RacketAlpha includes features powered by algorithms and artificial intelligence. You understand and agree that:

• AI-generated insights or analytics may be inaccurate, incomplete, or outdated.
• We make no warranties regarding the accuracy or reliability of AI outputs.
• You are solely responsible for how you interpret and use these insights.
• You must not rely on automated analytics as professional or financial advice.

FEEDBACK

We welcome feedback about RacketAlpha. By submitting feedback, you grant us a perpetual, worldwide license to use, modify, or incorporate it without obligation or compensation.

THIRD-PARTY CONTENT

RacketAlpha may integrate or display content from third parties (e.g., influencer social profiles, embedded posts, analytics sources). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party content or services.

USER DISPUTES

You are solely responsible for interactions with other RacketAlpha users, influencers, or brands. While we may moderate, Lowcode Garage is not liable for user disputes.

COPYRIGHT

If you believe your copyrighted work has been used on RacketAlpha in a way that constitutes infringement, contact team@racketalpha.com following the DMCA process.

TERMINATION

You may terminate your account at any time by contacting team@racketalpha.com.

We may suspend or terminate your account at any time, with or without notice.

Sections that by their nature should survive termination (including Intellectual Property, User Content, Disclaimer of Warranty, Limitation of Liability, Indemnification, and Dispute Resolution) will remain in effect.

DISCLAIMER OF WARRANTY & LIMITATION OF LIABILITY

RacketAlpha is provided "as is" without warranties of any kind, express or implied.

We are not liable for indirect, incidental, or consequential damages, or for any amount exceeding the greater of (a) what you paid in the last three months, or (b) $100.

INDEMNIFICATION

You agree to indemnify and hold harmless Lowcode Garage and its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the Service or your content.

DISPUTE RESOLUTION & CLASS ACTION WAIVER (U.S. Residents)

Disputes will be resolved through binding arbitration (except for certain intellectual property claims). You waive your right to participate in class actions or representative suits.

INTERNATIONAL USE & EXPORT

You agree to comply with all applicable export laws and local regulations when accessing or using RacketAlpha.

GENERAL

Governing Law: These Terms are governed by the laws of New York, without regard to conflict of laws principles.

Entire Agreement: These Terms constitute the full agreement between you and Lowcode Garage LLC.

Severability & Waiver: If any provision is invalid, the rest remain enforceable.

Assignment: You may not assign your rights or obligations under these Terms; we may assign ours.
